Who we are

Ptova is operated by Ptova LLC, a Utah limited liability company based in Pleasant Grove, Utah, United States. You can reach us at hello@ptova.com. In these terms, "we", "us" and "Ptova" mean Ptova LLC, and "you" means the person or organization buying or using our software.

By buying from us, creating an account, or using our software, you agree to these terms.

What we sell

We sell annual, per-site subscriptions that entitle you to download our software, receive updates for it, and get support, for the number of sites included in the plan you choose.

Your subscription buys access to updates, downloads and support. Your rights in the software itself come from the license that accompanies it, as stated in each product. The License Agreement explains how the two fit together.

Your account

Accounts are identified by email address. We do not use passwords: you sign in with a single-use link sent to your email, valid for 15 minutes. Anyone with access to that inbox can sign in to your account and see your license keys, so keep it secure. Tell us promptly if you believe your account or a license key has been compromised.

Prices, payment and tax

Prices are shown in US dollars and are exclusive of any tax unless stated otherwise. Payments are processed by Stripe. We never receive or store your full card details.

We may change prices at any time. A price change never affects a subscription term you have already paid for; it applies from your next renewal, and we will tell you before that renewal if the price has gone up.

Subscriptions, renewal and cancellation

• Subscriptions run for one year from purchase and renew automatically unless you cancel.
• You can cancel at any time from your account, which opens Stripe's billing portal.
• Cancelling stops future charges. It does not shorten the term you have already paid for — your license stays active until the end of that period.
• When a subscription lapses, delivery of updates for that license stops. See the License Agreement for what your rights in the software are after that point.

Refunds

We offer a 7-day refund window. The full terms are in our Refund Policy.

Acceptable use

You agree not to:

• Share, resell, publish or sublicense your license key, or use one key to obtain updates for sites beyond the number in your plan. The key is a credential for our services, and this restriction concerns the key rather than the code.
• Use our services in a way that interferes with them, or attempt to gain unauthorized access to accounts, systems or data that are not yours.
• Use the Ptova name or logo in a way that suggests we endorse or are affiliated with you when we are not. Trademarks are ours and are not covered by the software's license.

If you materially breach these terms, we may suspend or revoke your license key and cancel your subscription. Where the breach is fixable and not deliberate, we will contact you first.

Availability

We work to keep our licensing, update and download services available, but we do not guarantee uninterrupted or error-free service. We may change, suspend or discontinue any part of the service. If we discontinue a product entirely, we will not charge you for a renewal of it after that point.

Changes to the software

Software changes over time. We may add, change or remove features in an update. We aim to keep our products working with current versions of WordPress and, where relevant, WooCommerce.

Disclaimer

Except where the law does not allow it, our software and services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. You are responsible for keeping backups of your own sites and data.

Limitation of liability

To the fullest extent permitted by law, Ptova LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of our software or services.

To the fullest extent permitted by law, our total liability for any claim relating to our software or services is limited to the amount you paid us for the affected product in the 12 months before the claim arose.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

Changes to these terms

We may update these terms. If a change is material, we will update the "last updated" date above and, where we reasonably can, tell you by email. Continuing to use our software or services after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules. The courts located in Utah County, Utah will have exclusive jurisdiction over any dispute, and you and we both consent to that jurisdiction.
